Terms of Service

1. Acceptance of terms
By accessing or using Techmapr (“the Service”), operated by Dr. Alexander Hoffmann, Lutherstraße 38, 30171 Hannover, Germany (“we,” “us,” or “the Operator”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
These Terms apply together with our Privacy Policy and Cookie Notice, which are incorporated by reference.
2. Service description
Techmapr is a web-based software-as-a-service platform that helps teams map technologies, create technology radars, run AI-assisted research, manage recurring or one-shot intelligence subscriptions, receive optional email report delivery, and share read-only radar snapshots.
Certain features use artificial intelligence via the Google Gemini API to generate content such as technology scores, strategic recommendations, and research briefs. These features are described in more detail in Section 6 below.
Paid plans may offer higher limits and additional capabilities. Payments and subscription management are processed by Stripe (Stripe, Inc., San Francisco, CA, USA, and affiliates as applicable). Stripe handles payment credentials, checkout, billing portal actions, and invoice/tax records for purchases you make through the Service. We receive subscription status and limited billing metadata (for example, Stripe customer ID, subscription ID, plan/price ID, status, and current period end) needed to provide and manage paid features.
3. Account registration and security
You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at privacy [at] techmapr [dot] com if you suspect unauthorized access.
You must be at least 16 years old (or the minimum age required in your jurisdiction) to use the Service. By registering, you represent that you meet this age requirement.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to the Service, other user accounts, or our infrastructure.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Use automated scripts, bots, or scrapers to access the Service without our prior written consent.
- Upload or submit content that is defamatory, obscene, fraudulent, or infringes any third-party rights.
- Resell, sublicense, or redistribute access to the Service without our authorization.
- Circumvent any usage limits, rate limits, or access restrictions.
- Use stolen payment methods, engage in fraudulent chargebacks, or otherwise abuse paid-plan billing flows.
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice, depending on the severity of the violation.
5. Intellectual property
Our IP: The Service, including its design, code, branding, and documentation, is owned by the Operator and protected by copyright and other intellectual property laws. Nothing in these Terms transfers ownership of any of our intellectual property to you.
Your content: You retain all rights to the content you create or upload to the Service (e.g., radar configurations, workspace data, feature requests). By using the Service, you grant us a limited, non-exclusive license to store, process, and display your content solely to provide and improve the Service.
AI-generated output: Content generated by the AI features (scores, recommendations, research reports) is produced using third-party models (Google Gemini) and is provided to you for your use. We do not claim ownership of AI-generated output. However, you acknowledge that similar or identical output may be generated for other users based on similar inputs.
6. AI-generated content disclaimer
The Service uses Google Gemini models (including gemini-3-flash-preview, gemini-3.1-flash-lite, and, for certain paid intelligence workloads, gemini-2.5-pro or a configured successor model) to generate technology research, radar scores, strategic recommendations, intelligence reports, and text-polishing suggestions. You acknowledge and agree that:
- AI-generated content is informational and advisory only. It does not constitute professional, legal, financial, or technical advice.
- AI output may contain inaccuracies, errors, omissions, or outdated information. You are solely responsible for evaluating and verifying any AI-generated content before relying on it for decisions.
- We do not guarantee the accuracy, completeness, reliability, or fitness for any particular purpose of AI-generated content.
- Your input text is transmitted to Google Gemini for processing. Google processes this data under its API terms and states it does not use Gemini API input/output to train its foundation models.
7. Data and privacy
Our collection and use of personal data is governed by our Privacy Policy. By using the Service, you consent to data practices described therein. You may exercise your data rights (access, deletion, portability, etc.) as described in the Privacy Policy.
8. Service availability and modifications
We strive to provide reliable access to the Service but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue the Service (or any feature) at any time, with reasonable notice where practicable. We are not liable for any modification, suspension, or discontinuation.
9. Termination
You may terminate your account at any time by requesting account deletion through the profile settings or by contacting us. We may terminate or suspend your account for violation of these Terms or for any other reason with reasonable notice, except in cases of serious or repeated violations where immediate action is warranted.
Upon termination, your right to use the Service ceases immediately. We will delete your account data and user-scoped application data in accordance with our Privacy Policy retention schedule. You can request a self-service data export before deletion.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THIS DISCLAIMER APPLIES TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. MANDATORY STATUTORY WARRANTIES UNDER EU CONSUMER LAW REMAIN UNAFFECTED.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNTS YOU HAVE PAID TO US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR EUR 100, WHICHEVER IS GREATER.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR (A) DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, (B) FRAUD OR FRAUDULENT MISREPRESENTATION, OR (C) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, INCLUDING MANDATORY EU CONSUMER PROTECTION RIGHTS.
12. Indemnification
You agree to indemnify, defend, and hold harmless the Operator from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party. This indemnification obligation does not apply to consumers within the European Union to the extent prohibited by mandatory consumer protection law.
13. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict-of-law principles.
For users who are not consumers under EU law, the exclusive place of jurisdiction is Hannover, Germany.
For consumers within the European Union, mandatory consumer-protection laws of your country of residence apply to the extent they provide more favorable protections. The former EU Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 pursuant to Regulation (EU) 2024/3228. A list of consumer dispute resolution bodies in each Member State is available at consumer-redress.ec.europa.eu. We are not obligated and currently not willing to participate in dispute resolution proceedings before a consumer arbitration board.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
15. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you via email or an in-app notice. Your continued use of the Service after the effective date of a change constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service and delete your account.
